In order to provide further field guidance and clarification on the processing of merchandise imported for relief efforts, the guidelines established within this memo should be followed. As background, on August 29, 2005, the President of the United States declared that a major disaster exists in the States of Louisiana, Mississippi and Alabama and ordered Federal aid to supplement state and local recovery efforts in the area struck by Hurricane Katrina beginning on August 29, 2005. To support this effort, the Commissioner of U.S. Customs and Border Protection authorized the importation of merchandise for humanitarian purposes without entry and without payment of duty, taxes, or fees under 19 U.S.C. 1318(b)(2), as well as 1322(b) and the corresponding regulation of 19 CFR 10.107, for the sole purpose of relief efforts in the States of Louisiana, Mississippi, and Alabama.

In cases where goods are imported by foreign governments intended for disaster relief purposes, sanctioned by the State Department as an approved shipment and eligible for 19 U.S.C. 1322(b) or 19 U.S.C. 1318(b)(2) processing – the requirement for the advanced electronic filing cargo information through the Automated Manifest System (AMS) is waived. However, upon arrival, a paper cargo manifest must be provided by the arriving carrier and screened by the port for high-risk factors. Also, arriving foreign shipments processed under these guidelines must be logged and tracked locally by the port to document the following:

In cases where merchandise is imported into the U.S. by an established charitable organization, and the imported goods are consistent with the disaster relief efforts in the Gulf region, those goods are also admissible under 19 U.S.C. 1322(b) and 19 U.S.C. 1318(b)(2) as humanitarian shipments. Arriving foreign shipments processed under these guidelines must be logged and tracked locally by the port to document the following:

• Port of Entry
• Importer
• Consignee
• Description of Goods
• Quantity
• Country of Origin of the Goods
• Destination of the Goods

For those goods attempted to be imported into the U.S. by private groups or individuals, the application of 19 U.S.C. 1318(b)(2) and 19 U.S.C. 1322(b) for entry and clearance purposes will not be applied. These groups or individuals should be directed to contact an established charitable organization to determine the method by which they may donate for this relief effort. These groups or individuals can also be advised to visit the DHS website for additional information.

Shipments of emergency relief supplies, identified by CBP as having been accepted by the United States through the State Department, will be allowed to proceed without FDA review and PN data being submitted. FDA will attempt to obtain this information regarding such shipments in advance of arrival either through CBP or other means and will distribute this information to their field personnel as soon as possible.

In all other cases where the imported merchandise to be processed and released by CBP under 19 U.S.C. 1322(b) and 19 U.S.C. 1318(b)(2), is known to have other government agency requirements, every effort should be made to advise the responsible agency in order to provide them the ability to conduct inspections and make their own admissibility determinations based on their mission needs and requirements.

Field Offices should be aware that merchandise imported under 19 U.S.C. 1322(b) and 19 CFR 10.107 must be exported, expended, or destroyed within prescribed time-frames. Headquarters has amended the time-frame to allow for exportation to occur one-year from the date of importation. The Port Director may expand this time-frame, as necessary.
